In a detailed statement issued Monday, Acting Inspector General of Police Gilbert Masengeli addressed the controversial recall of Justice Lawrence Mugambi’s security detail.
Masengeli explained:
“The two officers, being general duty officers, were recalled for purposes of attending VIP security courses. We are aware that suitable arrangements were made to ensure Hon. Mugambi’s security was always assured.”
Withdrawal Not Linked to Recent Rulings
Masengeli strongly refuted allegations that the security withdrawal was linked to any recent rulings:
“It is in the public domain that the IG has accorded the Judiciary, just like the other arms of government, the requisite protection, both the institutions and the persons serving therein without favour or discrimination.”
Explanation for Court Absence
Addressing his non-appearance at a recent court proceeding, Masengeli stated:
“It is not clear why the Court insisted on the IG attending to this matter in person, yet an equally senior officer had been availed by the Service.”
He further clarified:
“For the avoidance of doubt, the issues arising in the matter in Court were not personal to the IG.”
Masengeli explained that ongoing operational meetings prevented his personal attendance, leading him to delegate the Deputy IG of the Kenya Police Service to represent him.
Chief Justice’s Concerns
This explanation follows Chief Justice Martha Koome’s criticism of Masengeli’s actions. CJ Koome had pointed out that the security detail was abruptly withdrawn over the weekend, with their firearms confiscated.
She argued that this move contradicted Article 160 of the Constitution, which protects the Judiciary’s independence.
